Who Pays for Radon Mitigation in a Pennsylvania Home Sale?

Answer

Pennsylvania law does not assign responsibility for radon mitigation cost in a home sale to either buyer or seller. It is a negotiated item, typically raised after a buyer's radon test during the inspection period, and resolved the same way other inspection findings are, through a price adjustment, a seller-paid repair, or a credit at closing.

In practice, the leverage in this negotiation usually follows the timing: a result found early, before an agreement of sale, tends to become the seller's problem to solve or disclose. A result found during a buyer's inspection period after an accepted offer more often becomes a negotiated credit or a seller-arranged fix as a condition of closing.

Either way, insisting on a certified installer and a documented post-mitigation test protects whoever ends up paying, since an undocumented or poorly done system becomes the next owner's problem regardless of who wrote the check.

Common questions

Is a radon test required to sell a house in Pennsylvania?

No statewide law requires it, but Pennsylvania's seller disclosure form does ask whether the seller has knowledge of radon testing or mitigation on the property, so known results have to be disclosed if they exist.

Does it matter who chooses the mitigation contractor if the seller agrees to pay?

It is reasonable for the buyer to have input, or at minimum to require PA DEP certification and a post-mitigation test as a condition, rather than accepting whichever contractor the seller found cheapest.
